Product Information

This Data Act Notice is drafted by and on behalf of Doosan Bobcat EMEA, s.r.o., a company with registered office at U Kodetky 1810, 263 12 Dobříš, Czech Republic and registered under the number 264 89 201 (hereinafter “Doosan Bobcat”, “we”, “us”, “our”). 

This Data Act Notice is provided pursuant to Doosan’s regulatory obligations under the EU Data Act (Regulation (EU) 2023/2854) for Doosan Bobcat machines, including machines that are able to exchange information with Machine IQ. 

Our machines, including any devices and components linked to them (“Connected Products”) generate data about your use, and the environment in which they are operated (“Product Data”). Product Data is generated continuously and in real-time during the use of Doosan Bobcat machines. Product Data may additionally be shared with and made available through (web) applications and software programmes (“Related Services”). The Related Services themselves may also generate data on user actions and events related to the Connected Products (“Related Service Data”). Please note that we only collect Product Data via the Related Services if and when you link Connected Products to a Related Service, whether through a technical action or agreement.

Below an overview is provided of the relevant Product Data and Related Service Data categories for both the Doosan Bobcat Connected Products and the Related Services. To make this as clear as possible, Doosan Bobcat has based itself on internationally approved standards for data classification in the sectors in which Doosan Bobcat operates namely ISO 15143-2:2010, ISO 15143-3:2020 and ISO 19944-1:2020.

 

1. Data access

To access the Product Data, you declare that you are the owner, renter or lessor of a Connected Product of Bobcat or an authorized dealer, on the basis of a written agreement. To access the Related Services and Related Service Data you declare that you are either the owner, renter or lessor of a Connected Product or receive a Related Service from Doosan Bobcat or an authorized distributor, on the basis of a written agreement.

Both the Product Data and Related Service Data are accessible and retrievable in accordance with the applicable terms and conditions, either through the on-board interface in the machine (which may require you to procure compatible software or hardware to access the data stored therein) or by registering and logging in to one of our online services or web applications such as My Machine or Machine IQ.

A subset of the data should be accessible and retrievable via the web portals linked to the machines (please see also the information on the related service below). Where this should not be the case or you deem your data access to be incomplete, please contact us via communications.emea@doosan.com for additional information. 

Please note that data not stored on the machines may be received by Doosan Bobcat with a delay (e.g., every 24h, upon switching off the machine, etc.). Moreover, the characteristics of the Product Data, including the format and volume in which data is made available, also varies depending on whether the data is accessed on the machine or via a web service:

2. Product data generated by Doosan Bobcat machines

Basic machine data
ISO 15143-2:2010
Fundamental attributes describing a particular machine at the worksite (e.g., ability, distinction number, classification, etc.).
Machine running state
ISO 15143-2:2010
Live operational and condition data of the machine when it is powered and operating (daily working and idle hours), covering engine, fuel usage, hydraulics, speeds, and diagnostics.
Measurement data
ISO 15143-2:2010
Data points that contain measurement and observation values.
Mission data
ISO 15143-2:2010
Contextual assignment information (including operator, supervisor, work area, mission times) that connects machine telemetry to a specific project task.
Digital input state
ISO 15143-3:2020
Data points related to the on/off status of binary signals (including switches/locks/sensors).
Fault, Caution and Diagnostic Trouble Codes

Data points related to active warning states and diagnostic fault codes on the machine (including identifier, severity and description).
Operating hours
ISO 15143-3:2020
Data points related to the total hours the engine has been on.
Location
ISO 15143-3:2020
Data points related to the last known location of the machine (i.e., timestamped machine position including latitude/longitude/altitude).
Fuel remaining ratio
ISO 15143-3:2020
Data points demonstrating the fuel level as a remaining percentage/ratio.
Cumulative power take-off hours
ISO 15143-3:2020
Data points related to the lifetime power take-off hours of the machine.
Cumulative fuel used
ISO 15143-3:2020
Data points related to the lifetime counter of total fuel consumption. It is the fuel equivalent of an odometer, and a key input for efficiency, cost, and emissions metrics.
Telemetry Data
ISO 19944-1:2020
Data points which are observed runtime measurements from components or services running in the machine, usually time-series, automatically collected and sent for monitoring and analysis. Virtually all of the counters, operating hours, positions, speeds, and usage logs are telemetry data.
Connectivity Data
ISO 19944-1:2020
Data points which are identifiers and configuration metadata that enable a device or service to connect and communicate (including serials, part numbers, firmware, network/session info).
Cloud Service Provider Data (operations)
ISO 19944-1:2020
The logs, records, and control/maintenance data that the provider generates or needs to keep the service running (system logs, resets, password changes, message transmissions, file transfers), but only to the extent that they specifically relate to the user use of cloud-enabled features on the machine.

3. Product and Related Service Data on Doosan Bobcat Related Services

Related Service Data Cloud service customer data includes content directly created by customers and their users and all data, including all text, sound, software or image files that customers provide to the cloud service, or are provided to the cloud service on behalf of customers, through the capabilities of the service or application. E.g. credentials provided by the customer to identify a user to the device, application or cloud service, e.g. passwords, password hints, etc. (access & authorization).

Related Service Data This refers to data provided or captured about the users’ interaction with the service or products by the cloud service provider. Captured data includes the records of the users’ preferences and settings for capabilities, the capabilities used and commands provided to the capabilities.
User location
ISO/IEC 19944-1:2020
Related Service Data This refers to data in the form of records of the location of the user within a specified degree of precision.

Sensor measurement data

Related Service Data Data that has been obtained from a measurement sensor. Sensor measurement data are typically organizational data.

Related Service Data This refers to data in the form of the physical environment captured by sensors as the user exercises an application or cloud service’s capabilities.
Telemetry data
ISO/IEC 19944-1:2020
Related Service Data This refers to data collected about the capabilities of the product or service. Examples are measurement, performance and operations data. Telemetry data represents information about the capability and its use, with a focus on providing the capabilities of the product or service.
Connectivity data

Related Service Data This refers to data that describes the connections and configuration of the devices connected to the service and the network, including device identifiers, (e.g. IP addresses) configuration, settings and performance.

4. Retention and erasure 

Retention. In general, Product Data and Related Service Data is retained only as long as needed to provide the functionality of the Connected Products and any Related Services as set out in the specific agreements you concluded with Doosan Bobcat, including to ensure the functionality and safety of the machines (e.g. software updates, product improvement) and to meet security and legal data retention requirements (e.g. statutory retention periods).

Deletion on device. Device-resident Product Data can be deleted by performing a factory reset. More information on how to do so can be retrieved by contacting communications.emea@doosan.com. Please note that a factory reset might have a great impact. There is no additional option for the user to delete product data on the machines.

Deletion in web applications. Doosan Bobcat provides access to Product Data and Related Service Data via its web applications. You are allowed to delete the data in those web applications. Please note that this is a manual process for which you should contact communications.emea@doosan.com

 

5. Legal and security 

Data protection: please note that some of the Product Data and Related Service Data mentioned above may qualify as personal data under the General Data Protection Regulation. For more information on how personal data is processed, we refer to our Bobcat Privacy Policy and the Bobcat Telematics System General Information and Privacy Notice found in the operations manual. 

Trade secrets. The Product Data and Related Service Data may contain trade secrets of Bobcat. As a user may only share the Product Data with third parties or further make use of such Product Data, subject to the restrictions imposed by the EU Data Act and subject to any additional conditions agreed between the user and Doosan Bobcat. 

Contract duration. More information on the duration of the contract and the arrangements for terminating the contract can be found in the terms and conditions for the Connected Product and/or Related Service.
